The fall of the US agreement regarding data has complicated the situation for Brexit. The Court of Justice for the CJEU have shut down the agreement regarding the Privacy Shield. The UK now has to face Brexit and the possibility of various legal issues regarding sending data to the US and the EU. The decision from the CJEU could also mean that even more issues are generated when it comes to data flow between the EU and UK. If a trade deal with the US is struck, then this could complicate things with the EU. Prior to the decision, it would seem that US and UK data flow was uncomplicated. The UK was to continue to be part of the privacy shield and the data would flow accordingly. This was going to be unrelated to any adequacy decisions from the European Union. Data transfers from the US to the UK are unaffected for now, and they are unrestricted due to Brexit and the closure of the privacy field.
Domestic Law and International Commitments
Organisations cannot rely on the privacy shield as a way to handle cross-border transfers from the EU to the US. US law gives any US authority the right to collect data about any EU subjects without safeguarding. On top of this, EU data subjects do not have the means required to seek redress against the US government. The CJEU’s decision creates a lot of uncertainty about the legal mechanism for the transfer of personal data outside of the EU. SCCs are essentially a standard of conditions that have all been approved by the EU Data Act. It requires the exporter, or the importer of any personal data to offer the same level of protection for EU data. It also states the importance of recognising EU data as a third-party beneficiary, in the contract with a right to enforce. The CJEU have upheld the general validity of the SCCs, but they have noted that any data that is transferred has to have the same level of protection in terms of the GDPR and the EU Charter for Fundamental Rights.
